WASHINGTON — U.S. Senator Mark Kelly of Arizona filed a federal lawsuit Monday against Defense Secretary Pete Hegseth and the Department of Defense, alleging that recent disciplinary actions taken against him constitute unconstitutional retaliation for protected political speech.

According to the complaint, Kelly challenges a formal censure issued by the Pentagon and related administrative steps that could lead to a reduction in his retired military rank and a loss of retirement benefits. Kelly, a retired U.S. Navy captain and former astronaut, argues that these actions stem from his participation in a publicly released video that encouraged U.S. service members to follow the Constitution and refuse unlawful orders.

The lawsuit asserts that punishing a sitting member of Congress for engaging in political expression violates the First Amendment and undermines long-standing constitutional protections designed to safeguard free speech and legislative independence. Kelly’s filing seeks to block enforcement of the censure and prevent any change to his retirement status, while also asking the court to declare the Pentagon’s actions unlawful.

Defense Department officials have stated that the measures were initiated due to concerns about military discipline and conduct standards applicable to retired officers. Kelly disputes that interpretation, arguing that the relevant statutes do not authorize disciplinary action based on political speech delivered after active service, particularly when the speech concerns constitutional obligations.

The case raises broader questions about the limits of executive authority, the rights of retired military officers who hold elected office, and the balance between civilian leadership, military discipline, and free expression. Legal experts say the outcome could have implications for how former service members participate in public debate on national security and military policy.

The Department of Defense has not provided detailed public comment on the lawsuit. The case is expected to proceed in U.S. District Court in Washington, D.C., where preliminary motions may be considered in the coming weeks.
