The U.S. Department of Homeland Security announced Thursday that Mahmoud Khalil will be re-arrested and deported to Algeria, according to a statement from DHS spokesperson Tricia McLaughlin.
The announcement follows months of legal proceedings stemming from Khalil’s arrest in March and his subsequent detention. A federal appeals court later reversed a lower court ruling, leading to a judge ordering Khalil’s release in June after several months in custody.
Federal authorities allege that Khalil provided false information on residency applications and claim he supports Hamas, an organization designated by the United States as a foreign terrorist group. Khalil has denied supporting violence, and his legal team disputes the government’s allegations, arguing that the detention and deportation actions are unlawful and remain subject to ongoing legal appeals.
Advocacy organizations have raised concerns that Khalil’s case could represent the first in a broader pattern of enforcement actions targeting immigrant university students involved in pro-Palestinian activism. They warn such actions may have implications for free speech and political expression.
Secretary of State Marco Rubio has cautioned that the case could carry adverse foreign policy consequences for the United States, particularly in how American civil liberties protections are perceived internationally.
DHS framed the case as a broader warning to non-citizens residing in the United States. McLaughlin described the enforcement action as “a reminder for those who are in this country on a visa or on a green card” to fully comply with U.S. immigration laws.
Khalil’s legal team maintains that his political views and activism are protected under the First Amendment and continues to challenge the government’s actions through the courts. Legal proceedings related to the case remain ongoing.
