Pentagon proceedings could lead to reduction in retired rank and military pension

WASHINGTON — Defense Secretary Pete Hegseth has confirmed that the Department of Defense has initiated administrative proceedings against U.S. Senator Mark Kelly of Arizona, a move that could result in a reduction of Kelly’s retired military rank and a corresponding decrease in his military pension.
Kelly, a Democrat and retired U.S. Navy captain, is facing a formal review related to public remarks he made regarding the conduct of military personnel and the obligation to refuse unlawful orders. According to the Pentagon, the review process includes a retirement grade determination, an administrative mechanism used to assess whether a retired service member should retain their final rank based on conduct.
In a public statement, Secretary Hegseth said the actions were necessary to uphold military discipline and standards, emphasizing that retired officers remain subject to certain military regulations. He confirmed that the process does not involve criminal charges but could carry long-term financial and symbolic consequences.
The proceedings stem from a video released in late 2025 in which Kelly and several Democratic lawmakers addressed active-duty service members, urging adherence to the Constitution and warning against following unlawful commands. Administration officials argued the message crossed a line by potentially encouraging insubordination.
Senator Kelly has strongly rejected the Pentagon’s actions, calling them politically motivated and an attack on free speech. He defended his statements as consistent with military law and constitutional principles, noting that service members are legally required to refuse unlawful orders.
